Rules governing the admissibility of evidence

Fed. R. Evid. 608(b) (specific instances of the conduct of a witness "if probative of truthfulness or untruthfulness" may be inquired into during the cross-examination of the witness).Prior acts of a witness may be elicited during the interrogation of the witness to impeach the truthfulness of a witness, but the acts so inquired into must in fact be probative of truthfulness.

Fed. R. Evid. 807.Statements that fall within an exception to the hearsay rule are admissible to prove the truth of the matter asserted by the declarant (the maker of the statement).

Lillard, 354 F.3d 850, 854 (9th Cir. 2003) (upholding trial court's admission into evidence of accused's theft of cocaine because it was inextricably intertwined with the conspiracy crime as it established the elements of identity and knowledge ).Other crimes, wrongs, or acts are admissible and do not violate the prohibition against the use of character to show conduct if such acts are admissible to show the context of an event at issue at trial or to tell the full story or an intelligible story of a series of events at issue at trial.
