A subsequent remedial measure is a measure that was (i) taken after an injury or harm that was allegedly caused by some event, and that (ii) if taken before such an event (such as the breaking of a ladder) would have made the injury or harm less likely to occur.

Cates v. Morgan Portable Building Corp., 780 F.2d 683, 691 (7th Cir. 1985) (holding, in plaintiff buyers' action for breach of contract against defendant portable building manufacturer, that evidence of stipulation of September 1973....Although settlement negotiations and offers are inadmissible (i) to show the validity or invalidity of a claim when validity is in dispute, (ii) to show the amount of damages when the amount is in dispute, or (iii) to impeach by showing a prior inconsistent statement or specific contradiction, they are admissible when they are offered to support or oppose a claim based on a settlement agreement.

United States v. Banks, 514 F.3d 769, 777-778 (8th Cir. 2008) (upholding trial court's admission into evidence of the ATF purchase form under the residual hearsay exception because all the requirements have been met,....A statement is admissible under the hearsay exception created by Federal Rule of Evidence 807 or a comparable State rule only if circumstantial evidence shows that the affected statement is as trustworthy as the statements that are made admissible by the hearsay exceptions created by Federal Rules of Evidence 803 and 804 or by comparable State rules.

Henderson v. George Washington University, 449 F.3d 127, 140-141 (D.C. Cir. 2006) (holding, in plaintiff patient's action against defendant surgeon for breach of standard of care, that "the district court greatly overestimated the potential....The doctrine of curative admissibility may apply even if an opponent did not use inadmissible evidence; the doctrine may be used if an opponent urges the trier to draw improper inferences from admissible evidence.
