The prohibition against evidence of subsequent remedial measures extends to corrective or remedial measures and is not limited to "repairs."

Fed. R. Evid. 804(b)(1) advisory committee's note ("As a further assurance of fairness in thrusting upon a party the prior handling of the witness, the common law also insisted upon identity of parties, deviating only to the extent of allowing substitution of successors in a narrowly construed privity. Mutuality as an aspect of identity is...The hearsay exception for prior testimony can apply in a criminal trial or proceeding against a defendant even if the prosecuting party and offeror in the prior trial or proceeding was a different party and offeror (e.g., a different governmental unit).

United States v. Carson, 455 F.3d 336, 379-380 (D.C. Cir. 2006) (upholding trial court's refusal to admit the grand jury testimony of unavailable witnesses because "[defendants had] failed to show how the motive to develop....The hearsay exception for prior testimony applies in a criminal case only if the if the party against whom the testimony is now offered had an opportunity and similar motive to develop the testimony in the prior proceeding by direct, cross, or redirect examination. The exception applies in a civil action or proceeding only if the party against whom the testimony is now offered or a predecessor in interest had an opportunity and similar motive in the prior proceeding to develop the testimony by direct, cross, or redirect examination.

McMorrow v. Schweiker, 561 F. Supp. 584, 589 (D.N.J. 1982) (holding, in plaintiff's claim for widow's insurance benefits, that the Secretary properly denied the claim because (1) "[n]one of the forms of preferred....Federal Rule of Evidence 803(12) or a comparable State rule creates a hearsay exception for statements of fact contained in a certificate that the maker performed a marriage or other ceremony or administered a sacrament, made by a clergyman, public official, or other person authorized by the rules or practices of a religious organization or by law to perform the act certified, and purporting to have been issued at the time of the act or within a reasonable time thereafter.
