If behavior is largely volitional rather than semi-volitional or semi-automatic, it is hot habit.

Hernandez, 333 F.3d 1168, 1176-1180 (10th Cir. 2003) (upholding trial court's admission of the serial number records of friend Jacqueline Grant and defendant's sister, Renee Hernandez as recorded recollection....Federal Rule of Evidence 803(5) or a comparable State rule creates a hearsay exception for a memorandum or record concerning a matter about which a witness once had knowledge but now has insufficient recollection to enable the witness to testify fully and accurately, shown to have been made or adopted by the witness when the matter was fresh in the witness' memory and to reflect that knowledge correctly.

Fed. R. Evid. 103(a) ("Error may not be predicated upon a ruling which admits . . . evidence unless . . . (1) Objection. In case the ruling is one admitting evidence a timely objection or motion appears of record").An objection ordinarily must be contemporaneous with the offer of evidence; that is, ordinarily an objection must be made after an offer of evidence is made but before the the trial court rules on the admissibility of the offered evidence.

Evid. 807 (a "statement not specifically covered by Rule 803 or 804" must have "equivalent circumstantial guarantees of trustworthiness" if the statement is to be admissible under Rule 807).A statement is admissible under the hearsay exception created by Federal Rule of Evidence 807 or a comparable State rule only if circumstantial evidence shows that the affected statement is as trustworthy as the statements that are made admissible by the hearsay exceptions created by Federal Rules of Evidence 803 and 804 or by comparable State rules.
