Fed. R. Evid. 803(2) ("A statement relating to a startling event or condition made while the declarant was under the stress of excitement caused by the event or condition.").A statement falls within the hearsay exception created by Federal Rule of Evidence 803(2) or a comparable State rule for excited utterances, only if the declarant (the maker of the statement) was under the stress of the startling event or condition when he or she made the statement that relates to that startling event or condition.

Fed. R. Evid. 901(b)(10) ("Any method of authentication or identification provided by Act of Congress or by other rules prescribed by the Supreme Court pursuant to statutory authority.").Federal Rule of Evidence 901(b)(10) provides that the authentication requirement imposed by Federal Rule of Evidence 901(a) is satisfied (a) by any method of authentication or identification provided for by an Act of Congress, and (b) by any method of authentication or identification provided for by a rule prescribed by the Supreme Court pursuant to statutory authority.

Evid. 801(c) ("'Hearsay' is a statement, other than one made by the declarant while testifying at the trial or hearing, offered in evidence to prove the truth of the matter asserted.").Hearsay is a statement that (i) is made other than at the trial or proceeding at which it is offered and (ii) is offered to prove the truth of the matter asserted by the maker of the statement, the declarant.
