Only an utterance that contains an assertion can amount to a "statement" for purposes of Federal Rule of Evidence 801(a) or hearsay under Federal Rule of Evidence 801(c).

Commissioner, 820 F.2d 1543, 1547 n.5 (9th Cir. 1987) (holding that "prior testimony of Arthur Wells, Jr. [Nelson's attorney] and Walter Joe [a Margolis associate] was offered by the Commissioner as former....For purposes of the hearsay exceptions created by Federal Rule of Evidence 804 or a comparable State rule, a declarant is "unavailable" within the meaning of Rule 804(a) or a comparable State rule if the declarant testifies to a lack of memory of the subject matter of the declarant's statement; but a declarant is not "unavailable" if such claim of lack of memory is due to the procurement or wrongdoing of the proponent of a statement for the purpose of preventing the witness from attending or testifying.

Evid. 608(a) ("The credibility of a witness may be ... supported by evidence in the form of opinion or reputation, but subject to these limitations: (1) the evidence may....If one party uses reputation or opinion evidence to impeach a witness, an opposing party may use, respectively, either reputation evidence or opinion evidence about truthfulness to rehabilitate the witness.
