Does the rule limiting the admissibility of subsequent remedial measures extend to remedial measures that are offered to show a defect in a product, a defect in a product's design, or a need for a warning or instruction?

Aleskerova, 300 F.3d 286, 296-297 (2d Cir. 2002) (upholding trial court's admission into evidence of theater museum items because, "even though an in limine motion was insufficient to preserve for appeal objections based on deficiencies in foundation evidence," "it remained the...Evidence of another crime, wrong, or act is admissible if there is sufficient evidence to support a finding by a reasonable juror that the other crime, wrong, or act occurred. Clear and convincing evidence is unnecessary; "sufficient" means only that there must be enough evidence to make the other crime, wrong, or act relevant.

Fed. R. Evid. 404(a)(2) ("evidence of a character trait of peacefulness of the alleged victim offered by the prosecution" is admissible "in a homicide case to rebut evidence that the alleged victim was the first aggressor").In a a criminal trial for homicide, the prosecution may offer the peaceable character of victim to rebut accused's claim that victim was the aggressor.

United States v. Carson, 455 F.3d 336, 379-380 (D.C. Cir. 2006) (upholding trial court's refusal to admit the grand jury testimony of unavailable witnesses because "[defendants had] failed to show how the motive to develop....The hearsay exception for prior testimony applies in a criminal trial or proceeding only if the prior testimony was given against the person who is now the defendant in the criminal proceeding or trial.
