Privilege for confidential communications between social workers and clients; privilege for confidential information about clients acquired by social workers

United States v. Terry-Crespo, 356 F.3d 1170, 1177 (9th Cir. 2004) (upholding trial court's admission of the statement of a victim-informant [when he made a 911 call] as an excited utterance because (1) "Mr. Domingis called....A statement falls within the hearsay exception created by Federal Rule of Evidence 803(2) or a comparable State rule for excited utterances, only if the declarant (the maker of the statement) was under the stress of the startling event or condition when he or she made the statement that relates to that startling event or condition.

Fed. R. Evid. 412(b)(1)(B) ("(1) In a criminal case, the following evidence is admissible, if otherwise admissible under these rules: ... (B) evidence of specific instances of sexual behavior by the alleged victim with respect to the person accused of the sexual misconduct offered by the accused to prove consent or by the prosecution").In criminal proceedings evidence of specific instances of alleged victim's sexual conduct with accused on other occasions is admissible to show victim's consent to have intercourse or sexual relations with accused.

United States v. LaFlam, 369 F.3d 153, 156-157 (2d Cir. 2004) (upholding trial court's admission into evidence of accused's uncharged drug use where it was relevant to establish accused's financial need which had driven or provided him with motive to commit the crimes charged).Another act, wrong, or crime is admissible to show a motive for some alleged conduct on a particular occasion.
