Fed. R. Evid. 807(A) (statement admissible under Rule 807 only if "the statement is offered as evidence of a material fact").The hearsay exception created by Federal Rule of Evidence 807 or a comparable State rule applies only if the the affected statement is evidence of a material fact.

Fed. R. Evid. 412(c) ("(1) A party intending to offer evidence under subdivision (b) must -- (A) file a written motion at least 14 days before trial specifically describing the evidence and stating the purpose for which it is offered unless the court, for good cause requires a different time for filing or permits filing during trial;...If a party in a case involving a charge or claim of sexual assault wishes to offer evidence of the sexual disposition of the victim or the sexual conduct of the victim on other occasions, the offeror may be required by a rape shield law to give advance notice of the offeror's intent to do so.

Fed. R. Evid. 414 ("In a criminal case in which the defendant is accused of an offense of child molestation, evidence of the defendant's commission of another offense or offenses of child molestation is admissible, and may be considered for its bearing on any matter to which it is relevant.").Federal Rule of Evidence 414 and comparable rules in a few States create an exception to the prohibition against "circumstantial" use of character -- the prohibition against the use of character to show conduct -- by providing that in a criminal trial for child molestation or child sexual abuse, evidence of the defendant's commission of another offense or offenses of child molestation or child sexual abuse is relevant and admissible.
