Fed. R. Evid. 803(8) ("Records, reports, statements, or data compilations, in any form, of public offices or agencies, setting forth (A) the activities of the office or agency, or (B) matters observed pursuant to duty imposed by law as to which matters there was a duty to report, excluding, however, in criminal cases matters observed by...An exception to the hearsay rule applies to the following records of government offices and agencies: (A) public records that set forth the activities of the government office or agency; (B) public records that set forth observations that a government office or agency was required to make and report but this exception does not apply in criminal cases to observations of police officers and other law enforcement personnel; or (C) in civil actions and proceedings and in criminal cases when offered against the government, factual findings resulting from an investigation made pursuant to authority granted by law, unless the sources of information or other circumstances indicate the untrustworthiness of such findings.

United States v. Romero-Cruz, 201 F.3d 374, 377 (5th Cir. 2000) (on appeal court rejected criminal defendant's thesis that the government's deportation of the alien witnesses without permitting interviews violated his....The exclusion of exculpatory evidence in a criminal trial does not violate the constitutional right to present a defense and is not constitutionally arbitrary or disproportionate if the excluded evidence either is immaterial or has very little or no probative value.

United States v. Jennings, 496 F.3d 344, 349-350 (4th Cir. 2007) (upholding trial court's admission of testimony of two passengers [about the statements of the 13-year old girl on what had occurred on the flight] as excited....A statement falls within the hearsay exception created by Federal Rule of Evidence 803(2) or a comparable State rule for excited utterances, only if the declarant (the maker of the statement) was under the stress of the startling event or condition when he or she made the statement that relates to that startling event or condition.
