Federal Rule of Evidence 803(16) and comparable State rules create a hearsay exception for statements in an authenticated document that is more than a certain number of years old, typically twenty years.

Brocklesby v. United States, 767 F.2d 1288, 1292-1293 (9th Cir. 1985) (holding, in plaintiff survivors' actions against defendants US government and company for negligence, breach of warranty, and strict liability, that evidence....Although settlement negotiations and offers are inadmissible (i) to show the validity or invalidity of a claim when validity is in dispute, (ii) to show the amount of damages when the amount is in dispute, or (iii) to impeach by showing a prior inconsistent statement or specific contradiction, such settlement offers and negotiations are admissible if they are used to impeach a witness by showing the bias or interest of the witness.

Wolak v. Spucci, 217 F.3d 157, 160 (2d Cir. 2000) (holding, in policewoman's civil action for gender discrimination, that evidence of plaintiff's out-of-work sexual behavior was inadmissible where defendants failed to show that such evidence outweighed the danger of harm and unfair prejudice).Rape shield laws frequently make it impermissible -- sometimes in trials of civil actions as well as in criminal trials -- to introduce evidence either to show that an alleged victim of sexual wrongdoing engaged in other sexual behavior or to show the alleged victim's sexual predisposition.

United States v. Peneaux, 432 F.3d 882, 892 (8th Cir. 2005) (upholding trial court's admission of the victim child's prior out-of-court statements pursuant to Rule 807 because "[t]he government provided the requisite....A statement not specifically covered by Federal Rule of Evidence 803 or 804 or by comparable State rules, but having equivalent circumstantial guarantees of trustworthiness, is not excluded by the hearsay rule, if the court determines that (A) the statement is offered as evidence of a material fact; (B) the statement is more probative on the point for which it is offered than any other evidence which the proponent can procure through reasonable efforts; and (C) the general purposes of these rules and the interests of justice will best be served by admission of the statement into evidence.
