A statement by an agent or an employee can be treated as a vicarious admission of a principal or an employer (respectively) -- an admission that, like other admissions, is exempt from the prohibition against hearsay -- only if the agent's principal or the employee's employer is a party and the agent's or employee's statement is offered against the agent's principal or the employee's employer.
