To qualify as a statement of present sense impression for purposes of the hearsay exception by that name, the statement made by the declarant (the maker of the statement) must describe or explain an event or condition.

Gabe, 237 F.3d 954, 960 (8th Cir. 2001) (upholding trial court's admission of testimony about two prior incidents of sexual abuse because it was probative as "it tends to prove [accused's] propensity to molest young children in his family when presented with an opportunity to do so...Federal Rule of Evidence 414 and comparable rules in a few States create an exception to the prohibition against "circumstantial" use of character -- the prohibition against the use of character to show conduct -- by providing that in a criminal trial for child molestation or child sexual abuse, evidence of the defendant's commission of another offense or offenses of child molestation or child sexual abuse is relevant and admissible.

United States v. Avants, 367 F.3d 433, 444-445 (5th Cir. 2004) (upholding trial court's admission of the 1966 preliminary hearing testimony through Rule 804(b)(1) because the "[defendant] has not presented any reason why....The hearsay exception for prior testimony applies in a criminal case only if the if the party against whom the testimony is now offered had an opportunity and similar motive to develop the testimony in the prior proceeding by direct, cross, or redirect examination. The exception applies in a civil action or proceeding only if the party against whom the testimony is now offered or a predecessor in interest had an opportunity and similar motive in the prior proceeding to develop the testimony by direct, cross, or redirect examination.

United States v. Austrew, 202 F. Supp. 816, 822 (D. Md. 1962) (upholding trial court's admission of a birth certificate [which was offered to prove the age of victim Shirley Monroe] as a public record because "the document was properly sealed and certified.").There is a hearsay exception for government records of births, fetal deaths, deaths, or marriages if such records are based on legally-required reports made to a public office.
