The Supreme Court of the United States has declared that certain types of statements are either "testimonial" or "non-testimonial" and are therefore either subject to or exempt from, respectively, the right of confrontation guaranteed to criminal defendants in both federal and state trials by the Sixth Amendment to the U.S. Constitution.
