General structure and main phases of proof at trial

United States v. Reynoso-Uloa, 548 F.2d 1329, 1341 (9th Cir. 1977) (upholding trial court's admission of agent's testimony about accused's previous heroin transactions because such evidence was offered to prove accused's predisposition after he relied on entrapment as a defense).A subjective entrapment defense makes an accused's criminal liability contingent on a finding of the accused's predisposition or the accused's lack of predisposition to commit the crime charged and since criminal predisposition is a character trait, the defense of subjective entrapment makes accused's character an element of either a defense or a criminal charge, evidence of accused's criminal predisposition -- including evidence in the form of reputation, opinion, and evidence of specific instances of accused's conduct -- is not barred by the rule against the use of a person's character to show the person's conduct.

United States v. Gabe, 237 F.3d 954, 960 (8th Cir. 2001) (upholding trial court's admission of testimony about two prior incidents of sexual abuse because it was probative as "it tends to prove [accused's] propensity to molest young children in his family when presented with an opportunity to do so...Evidence of a person's other sexual misconduct is frequently admissible in sexual assault cases, child molestation cases, and in civil cases involving claims of sexual misconduct.

Santa Barbara Capital Mgmt. v. Neilson (In re Slatkin), 525 F.3d 805, 812-813 (9th Cir. 2008) (holding, in plaintiff trustee's adversary proceeding against defendant investors, that the bankruptcy court properly admitted the debtor's plea agreement....The hearsay exception created by Federal Rule of Evidence 807 or a parallel State rule applies only if admission of the affected statement in evidence serves the interests of justice and the general purposes of the law of evidence.
