The hearsay exception for contemporaneously-existing states of mind does not encompass the use of a present state of mind to prove a past fact that is remembered or believed but a statement can be used to show a past fact remembered or believed if the statement relates to the execution, revocation, identification, or terms of the will of the declarant (the maker of the statement).
